Please read these Terms carefully before using Lodgya. By accessing or using any Lodgya product, you agree to be bound by these Terms.

In these Terms, the following definitions apply:
Lodgya is a record-keeping and organisational tool. It is designed to assist users in organising their income, expense, and tax-related records for Australian tax purposes. The Service generates summaries, reports, and calculations based solely on data entered by the user.
Lodgya is not a tax agent, financial planner, accountant, BAS agent, or legal adviser. The Service does not lodge documents with the ATO or any other government body on your behalf. Nothing in the Service constitutes or should be treated as professional advice of any kind.
This is the most important section of these Terms. Please read it carefully.
All figures, estimates, calculations, reports, and summaries generated by Lodgya are based solely on data that you enter. Lodgya makes no representation that such figures are accurate, complete, or compliant with Australian tax law or any other law.
Specifically, you acknowledge and agree that:
Lodgya is a record-keeping software tool. It does not provide tax agent services as defined by the Tax Agent Services Act 2009 (Cth), and does not lodge documents or give tax advice on your behalf.
To access certain features of the Service, you may need to create an account. You agree to provide accurate and complete information when creating an account and to keep your login credentials secure. You are responsible for all activity that occurs under your account.
You must be at least 18 years of age to use the Service.
We reserve the right to suspend or terminate your account if we reasonably believe that you have breached these Terms or engaged in conduct that is harmful to other users or to us.
Lodgya offers a Free plan and one or more paid plans. The Free plan is limited to 10 transaction entries in each of the three apps (Personal, Property and Business). Paid plans are available at the prices published on the Subscription page and provide unlimited entries. Discounted rates may be offered from time to time through partner or member programs; eligibility for a partner rate depends on the information you provide at signup being accurate. Partner and member discounts apply to monthly plans only. If one is used on a yearly plan, we may remove it from the next renewal.
You retain full ownership of all Content you enter into Lodgya. By using the Service, you grant Lodgya a limited licence to process your Content solely for the purpose of providing the Service to you.
By default, data in Lodgya is stored locally on your device (in your browser's storage or in a file you choose). If you turn on optional cloud backup, an encrypted copy of your records is also stored on Lodgya's servers. Your records are encrypted on your device, using a passphrase you choose, before they are uploaded, so Lodgya cannot read them. Lodgya does not have your passphrase or recovery code and cannot reset them; if you lose both, your cloud backups cannot be recovered. You can turn cloud backup off at any time, which permanently deletes your cloud backups.
Cloud backup is an additional safeguard, not a guarantee. You remain responsible for maintaining backups of your own data and for keeping your passphrase and recovery code safe. Lodgya accepts no responsibility for data loss arising from browser clearing, device failure, a lost passphrase or recovery code, or any other cause.
Your account details and any partner or discount information you provide are handled by our sign-in and payment providers, as described in our Privacy Policy. How encrypted cloud backups are stored, including where they are held, is described in our Privacy Policy.
You agree not to:
All intellectual property rights in the Service — including the software, design, branding, trademarks, and documentation — are owned by or licensed to Lodgya. Nothing in these Terms grants you any right to use our intellectual property other than as strictly necessary to use the Service as permitted herein.
The Lodgya name, logo, and "Lodgya Property", "Lodgya Personal", and "Lodgya Business" marks are trademarks of Lodgya. You may not use them without our prior written consent.
To the maximum extent permitted by applicable law, Lodgya and its officers, directors, employees, and agents shall not be liable for:
Where liability cannot be excluded under Australian Consumer Law (ACL) — including under the guarantees in the Australian Consumer Law — our liability is limited, to the extent possible, to resupplying the Service or refunding the amount paid for the relevant subscription period.
Our total aggregate liability to you under these Terms shall not exceed the total subscription fees paid by you in the 12 months preceding the event giving rise to the claim.
The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
We do not warrant that ATO rates, tax brackets, depreciation rates, or other regulatory figures included in the Service are current or accurate at any given time. Tax law changes regularly — always verify rates with the ATO or your tax agent.
You agree to indemnify, defend, and hold harmless Lodgya and its affiliates, officers, employees, and agents from and against any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your Content; (c) your breach of these Terms; or (d) your violation of any law or the rights of a third party.
These Terms continue until terminated. You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time with or without cause, with or without notice. On termination, all licences granted to you under these Terms immediately cease.
We may update these Terms from time to time. We will notify users of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of the State of Victoria, Australia. You and Lodgya submit to the exclusive jurisdiction of the courts of Victoria, Australia for the resolution of any dispute arising under these Terms.
Nothing in these Terms limits any rights you may have under the Australian Consumer Law.
